Verdict Finding Doctor Guilty Of Health Care Fraud Upheld By D.C. Circuit

WASHINGTON, D.C. – The evidence presented at trial supported a jury’s conviction of a physician for health care fraud and making false statements on health care matters, the D.C. Circuit U.S. Court of Appeals ruled June 14. However, the appeals court reversed the 53-months sentence imposed by the lower court, finding that the court failed to give specific, individualized reasons for going above the non-guidelines sentence (United States of America v. Ehigiator O. Akhigbe, No. 10-3019, D.C. Cir.; 2011 U.S. App. LEXIS 12028).
