Louisiana Majority Reverses Ruling In Insurer’s Favor In Hurricane Gustav Dispute

BATON ROUGE, La. – A majority of a Louisiana appeals court on June 10 reversed and remanded a lower court’s ruling in favor of a homeowners insurer in a Hurricane Gustav coverage dispute, finding that general issues of material fact regarding whether the insured received notice of its policy cancellation preclude summary judgment (Manh An Bui v. Farmers Insurance Exchange, No. 2010 CA 1571, La. App., 1st Cir.).
