Judge Finds Court Lacks Subject Matter Jurisdiction Over Hurricane Katrina Suit

NEW ORLEANS – A federal district court lacks subject matter jurisdiction over a Hurricane Katrina coverage lawsuit, a Louisiana federal judge held July 19, rejecting an insurer’s contention that claimants were fraudulently misjoined and remanding the lawsuit to state court (Linda Thomas, et al. v. American National Property Insurance Company, No. 11-1085 SECTION “C” [3], E.D. La.; 2011 U.S. Dist. LEXIS 78829).
