Insurer’s Partial Payment Of PIP Claim Did Not Require Peer Review, Judge Finds

BOSTON – After finding that an insurer did not violate Massachusetts law by making only partial payment of a medical provider’s claim without conducting a peer review of the claim, a Massachusetts federal judge on Aug. 1 granted dismissal of the case (McGovern Physical Therapy Associates LLC v. Metropolitan Property & Casualty Insurance Co., No. 1:10-cv-12003, D. Mass.; 2011 U.S. Dist. LEXIS 83331).
