A FULTON COUNTY jury as awardedÂ more than $500,000 to a woman who saidÂ she was injured when a MARTA escalatorÂ suddenly accelerated, shooting her off theÂ end and causing the heavy bag around herÂ neck to wrench her neck.
In court filings, MARTA said thatÂ the only reported incident on July 11,Â 2003, involved the stopped escalatorÂ being used as a stairway upon which â€śanÂ elderly gentleman became dizzy and fell,â€ťÂ causing â€śa domino effect which caused theÂ individuals on the escalator to run off.â€ť
â€śMARTA claimed the accident neverÂ happened,â€ť said lead plaintiffâ€™s attorneyÂ Michael L. Goldberg of Fried RogersÂ Goldberg, describing the version hisÂ client told. â€śEssentially, she was on thatÂ 75-foot escalator at the Peachtree CenterÂ station, shopping for her business at theÂ Apparel Mart, and about one-third of theÂ way down, the escalator starting speedingÂ up,â€ť said Goldberg.
â€śEverybody star ted yelling andÂ screaming, the lady behind her gave herÂ baby to a big man behind her to hold, thenÂ a MARTA security guard came up and hitÂ the emergency stop,â€ť said Goldberg.Â Goldbergâ€™s client, Cynthia McCarty, whoÂ was in Atlanta shopping for the countryÂ club she manages in Lakeland, Fla., â€śhit theÂ floor running,â€ť the attorney said.
