Judge: Plaintiffs May Not Seek Punitives In Suit Over Defective Seat Belt Design

HATTIESBURG, Miss. – A couple suing over an accident that killed one of their children cannot seek punitive damages because there is a genuine dispute as to whether the seat belt design in their Ford Explorer was defective, a federal judge in Mississippi held July 19, granting the defendants’ motion for summary judgment (Matthew Riley, et al. v. Ford Motor Company, et al., No. 2:09-CV-148-KS-MTP, S.D. Miss., Hattiesburg Div.; 2011 U.S. Dist. LEXIS 78647).
