Policy Exclusion Precluded Coverage Of Homeowners Claim, 3rd Circuit Panel Rules

PHILADELPHIA – In a July 28 opinion, a Third Circuit U.S. Court of Appeals panel found that an insurer properly denied a claim under a homeowners policy’s subsurface water damage exclusion, upholding a lower court’s grant of summary judgment to the insurer on breach of contract and bad faith claims against it (Joseph Cozza v. State Farm Fire and Casualty Co., No. 10-2811, 3rd Cir.; 2011 U.S. App. LEXIS 15771).
