Ohio Court Upholds Default Judgment, Reverses Damages

CANTON, Ohio – The Fifth District Ohio Court of Appeals for Stark County on June 27 upheld a default judgment issued by a trial court in a nursing home negligence and wrongful death cause of action. However, the appeals court found that there was insufficient evidence for the trial court to award $255,000 in damages and remanded the action to the trial court (Andrea S. Hicks, et al. v. Extended Family Concepts, d/b/a Heather Ridge Commons, No. 2010CA00159 & 201000183, Ohio App., 5th Dist., Stark Co.; 2011 Ohio App. LEXIS 3227).
