Judge: Car Theft Claim Properly Denied Under Policy’s Fraud Exclusion

SAN FRANCISCO – Finding that no genuine dispute existed on whether a policyholder made false statements and failed to cooperate during his insurer’s investigation of his auto theft claim, a California federal judge on July 29 granted the insurer’s motion for summary judgment on bad faith and breach of contract claims against it (Jagat Ram v. Infinity Select Insurance, No. 09-2732, N.D. Calif.; 2011 U.S. Dist. LEXIS 83555).
