Flower Seller’s Complaint Over Hurricane Ike Claims Survives Dismissal Motion

HOUSTON – A Texas federal judge on July 29 held that the owners of a Houston-based flower chain sufficiently alleged claims including breach of contract, bad faith and fraud related to their insurer’s alleged failure to pay claims related to Hurricane Ike losses (Wholesale Flowers Inc., et al. v. Union Insurance Co., No. H-10-4029, S.D. Texas; 2011 U.S. Dist. LEXIS 83342).
