Fla. High Court: Statute Does Not Bar Insurance Guaranty’s Appraisal Request

TALLAHASSEE, Fla. – Amendments in 2005 to a statute requiring notice of the availability of mediation to an insured do not apply retroactively to a 2004 insurance policy to bar Florida Insurance Guaranty Association’s (FIGA) motion to compel appraisal of supplemental claims for hurricane damage, the Florida Supreme Court concluded June 30 (Florida Insurance Guaranty Association Inc. v. Devon Neighborhood Association Inc. d/b/a Devon Neighborhood & Condominiums A-J Association Inc., No. SC10-347, Fla. Sup.; 2011 Fla. LEXIS 1526; See December 2009, Page 18).
