5th Circuit Reverses, Remands Hurricane Katrina Ruling In Light Of Taranto

NEW ORLEANS – The Fifth Circuit U.S. Court of Appeals on June 10 reversed, vacated and remanded a lower federal court’s ruling that no class action could toll a contractual limitation period, finding that the Louisiana Supreme Court’s ruling in Taranto v. La. Citizens Prop. Ins. Corp. “appears to have changed – or at least clearly established – the applicable law” (Robert H. Dixey II v. Allstate Insurance Company, No. 10-30250, 5th Cir.; 2011 U.S. App. LEXIS 11829).
