Delaware Judge Denies Dismissal Of Homeowner’s Construction Defect Claims

NEW CASTLE, Del. – A Delaware judge on May 31 denied a motion to dismiss a construction defects complaint involving various problems with a newly constructed home, concluding that there were questions regarding whether the claims were time-barred (Jason Bochniak, et al. v. Blenheim at Bay Pointe LLC, No. N10C-12-245 PLA, Del. Super., New Castle Co.; 2011 Del. Super. LEXIS 256).
