Bad Faith, Fraud Claims In Homeowner’s Water, Mold Damage Case Survive Dismissal

SCRANTON, Pa. – Because a homeowner alleged more than 20 actions that he says evinced bad faith by his insurer, a Pennsylvania federal judge on June 20 ruled that the claim was sufficiently alleged to withstand the insurer’s motion to dismiss (Yuriy Pinkhasov v. Allstate Insurance, No. 3:11-cv-00171, M.D. Pa.; 2011 U.S. Dist. LEXIS 64933).
