Taser Incident Prompts Texans’ Lineman to Threaten Lawsuit
01/29/2007 - National Legal News
The Houston Texans' Fred Weary is threatening to sue the city if it does not satisfy requests made by the lineman in response to a November arrest resulting in a Taser shooting.
Weary stated on Friday that in a letter sent to Mayor Bill White and Police Chief Harold Hurtt, he made clear his belief that he is owed a public apology from the two arresting officers as well as monetary compensation from the city. In addition, Weary is calling for the city to re-examine its policies concerning racial profiling and use of Taser devices
According to the officers involved, Weary was stopped when they noticed his vehicle had no front license plate and they observed him driving in a suspicious fashion. Weary maintains that the officers were not justified in their actions against him.
Weary was also charged with misdemeanor resisting arrest, but had the charge dismissed after insufficient evidence was found against him.
Weary’s attorney claims the Texans’ offensive lineman could seek compensation totaling as much as $250,000 from the city. The attorney also stated that the city had 90 days to comply before the lawsuit was to be filed.
A spokesman for Mayor Bill White declined to comment.
